WCJ Rules New Rating Schedule Arbitrary and Invalid!

In a major decision for injured workers, a San Francisco Workers' Compensation Judge ruled in an opinion released Friday that the state's formula for calculating permanent disability benefits was arbitrary and not based on any empirical evidence such as wage loss.

The decision by Judge Jacqueline C. Duncan is destined for reconsideration by the Appeals Board. In the meantime, it's the first time a judge has ruled the schedule actually violates the law!
