Santa Barbara County's first workers' compensation fraud case to go to trial was thrown out by the judge last week. The judge ruled that, despite sub-rosa video of the worker lifting television sets and working on his car (he was on light duty for a claimed back injury), the evidence was insufficient as a matter of law to sustain a conviction.
This was after a first jury had deadlocked 10-2 for conviction.
The worker's attorney successfully argued that what was seen on the videos was nothing like the duties of bending over constantly in the field as was required on the job.
