Employer or Independent Contractor? It Can Make or Break Your Case...
We've reported before about the problems with employers erroneously classifying employees as independent contractors. (To read a guide on the subject put out by the Internal Revenue Service, CLICK HERE.)
In fact, SB 622 -- passed by the state legislature during this last session -- would have added severe penalties for employers who intentionally misclassified employees as independent contractors to avoid workers' compensation coverage expenses (vetoed by the governor at the last minute).
Well, in an effort to keep our employer-carrier-defense subscribers educated on the subject (as well as our applicant attorneys looking for ways to decide whether you've got a a comp or personal injury case on your hands), we've included a special report from Law.com - written by experts in the field - outlining useful criteria when making such classifications.
