Retroactivity Bill for Public Safety Infectious Disease Presumption Stayin' Alive

Labor Code Section 3212.8, passed in 2002, creates a presumption of industrial causation for certain blood-borne infections for public safety employees. The section is silent, however, regarding its retroactive application.

Senate Bill 726 would amend Section 3212.8 to make it retroactive.

Last week the Senate Labor and Industrial Relations Committee sent the bill on to the Appropriations Committee.
