CA/5:   Court Affirms Lack of Evidence in Valley Fever Case

In an unpublished opinion, the Fifth District has affirmed a trial court's jury decision that an employee who contracted "Valley Fever" didn't prove it happened at the work site.

Nor, the Court ruled, was there enough evidence to support a finding that the employer negligently or intentionally concealed the risk of contracting the disease at work.

The employee had worked at a power plant construction site in McKittrick, California, and had sued the general contractor in civil court.

The case is Wilson v. Alstom Power.
