DWC Posts Revised Audit Regs, Comments Welcome

The Division of Workers' Compensation has modified its proposed audit regulations. A 15-day notice of modification was posted on the DWC Web.

Members of the public may comment on the revisions until 5 p.m., January 30th.

Comments should be addressed to:

Maureen Gray, regulations coordinator
Department of Industrial Relations
Division of Workers' Compensation
1515 Clay Street, 18th floor
Oakland, CA 94162

Or by email to: dwcrules@hq.dir.ca.gov

The proposed revisions to the draft regulations clarify:

•   The mandatory contents of a workers' compensation claim file

•  The definition of the term "adjusting location"

•  The application of target audit criteria

•  The increase in penalties for violating an award or order of the Workers' Compensation Appeals Board, the Retraining and Return to Work Unit (formerly the Rehabilitation Unit), or the administrative director

•  The penalties for a materially incomplete or inaccurate supplemental job displacement benefit notice or return to work benefit notices.

Another proposed revision clarifies where informational changes to the new annual report of adjusting locations should be sent.
