The Division of Workers' Compensation has posted the 2009 DWC Audit Unit annual report and the ethics advisory committee's annual report.
The Audit Unit annual report provides information on how claims administrators audited by the DWC in 2008 performed and includes a ranking report.
The workers' compensation ethics advisory committee is a state committee independent from the DWC, that is charged with reviewing and monitoring complaints of misconduct filed against workers' compensation administrative law judges.
The Ethics Report
Among the ethic report's findings,
Number of complaints against judges filed in 2008:
1 by employees represented by attorneys,
23 by employees not represented,
0 by applicant attorneys,
5 by defense attorneys,
1 by claims administrator,
2 by lien claimants,

The Audit Report
The 2009 Audit Unit annual report details the results of 75 audits conducted in 2008 and provides statewide listing of all audits conducted together with analyses of cited violations and compensation found due and unpaid to injured workers.
Performance ratings, cited violations and compensation due are also detailed in exhibits for the individual audits. The report also includes the administrative director's ranking report which lists all claims administrators audited during the period according to their performance.
Among the audit report's findings:
The Audit Unit found and cited 5,222 violations against claims administrators with administrative penalties totaling $1,913,471.
A table listing all those carriers and administrators assessed penalties is found on page 11 and in the exhibits which follow page 13.
