Finally... one of the first decisions post-SB 899 to give us some direction regarding the retroactivity aspects of the new laws!
The WCAB has just ruled, in the en banc decision of Scheftner vs. Rio Linda School District (SAC 0326274, Oct. 4, 2004) that orders closing discovery are enough to keep the provisions of SB 899 from applying (including Labor Code Section 4663 and the new apportionment requirements)!
This certainly keeps the "old" law alive and well for many pending cases!

New En Banc Decision Clarifies
