Illinois Workers Compensation Act / Laws

Illinois Workers’ Compensation Act was enacted by Illinois legislature in 1911 to provide general welfare of the people, by providing compensation for accident injures or death suffered at the work place. Any worker who is injured on-the job can benefit from the Illinois Workers Compensation Act, until he or she fully recovers from their injuries. Under Illinois workers compensation laws, compensation benefits includes 100% coverage of medical benefits, lost wage benefit, reimbursement for travel, vocational retraining, compensation for disfigurement like cuts and burns, and lump sum settlement depending upon the types of injures and reasons for the accident.

Illinois Workers Compensation Act allows every person, firm, public or private Corporation – including hospitals, public service, religious or charitable associations, to receive compensation in the course of employment within this State, and without this State where the contract of employment is made within this State. The employer is responsible for providing workers’ compensation settlements to injured workers through self-insurance or through insurance policy at no cost to employees.

Earlier in the year, new legislation was signed into law regarding the Illinois Workers Compensation Act and certain changes were made. The amendments that are effective as of September 1, 2011 are as follows:

  • Changes to Intoxication Defense
  • Determination of Permanent Partial Disability
  • Reduction of Hospital and Non-Hospital Fee Schedules
